Woman Fears Safety After Misconduct Accusation Led to Hamilton County Magistrate Firing


In 2017, Hamilton County, Ohio magistrate Stuart Newberry was fired after a woman accused him of misconduct. According to the woman's accusation, Newberry had shown her a photo featuring another woman with her breasts exposed. The woman also accused Newberry of taking her photos when she was in his chambers. She claimed that her skirt was pulled up when Newberry took the photos with her phone.

When the accusations were made public, Newberry was actively working on a case that involved the woman's protection order, which she had filed against one of her former boyfriends. Newberry's sacking came in December 2017, and barely two months had passed when the former magistrate took legal action against the woman in early 2018. Newberry sued the woman for defamation, intentionally inflicting emotional distress, and malicious prosecution.


The 2018 lawsuit filed by Newberry remains pending in the Common Pleas Court of Hamilton County, and since then, the woman has come forward with a counterclaim. The counterclaim, filed by the woman's attorneys Rebecca Salley and Al Gerhardstein, states that Newberry's suing of the woman was to intimidate her and seek retribution. 


According to the woman's attorneys, she has been living in fear of her life ever since Newberry filed the lawsuit against her. The attorneys added that the actions of the former magistrate are setting a dangerous precedent, as the legal system is allowing a person accused of sexual misconduct to file a lawsuit for damages.


The attorneys representing the woman have pointed out the lack of Newberry putting up any kind of defense when he was fired as proof of his guilt. They also suggest that the woman's ability to correctly describe the woman whose breast-exposing photo Newberry showed her reflects that she is in the right.


Right now, the woman's fear is causing her to reach out to the community to raise awareness about her case. She hopes that by raising awareness, more people from the community will come out in her support.
